PARENTAL CONSENT, AUTHORIZATION, AND WAIVER

FOR MINOR’S USE OF ITYDITY’S SITE AND SERVICES

This consent, authorization, and waiver (the “Consent”) is made by you (“You” or “Your”) for the benefit of Your child and ItyDity LLC, a Colorado limited liability company at 1320 Crestmore Pl. Ft. Collins, CO 80521 (“ItyDity,” “We,” “Us,” or “Our”). You are the adult parent or legal guardian of a minor between the ages of 13 and 18 who intends to use ItyDity.com (the “Site”) and the Services ItyDity provides, as provided through the Site and governed under Our Terms of Use.

The nature and scope of Our Site and Services can be found at www.ItyDity.com, as well as in Our Terms of Use. In addition, Our privacy practices, including as they apply to minors, are detailed within Our Privacy Policy. By signing below, You voluntarily understand, agree, and acknowledge on behalf of You and Your child:

Your child is authorized by You to use Our Site and Services, without limitation.
You will provide any supervision to Your child that You deem necessary or appropriate while Your child uses Our Site or Services.
You have read and understood Our Terms of Use, Our Privacy Policy, and all additional agreements applicable to Your child’s use of Our Site and Services, agree with all of them, agree to comply with them, and AGREE TO BE FULLY BOUND BY THEM, INCLUDING BUT NOT LIMITED TO THE LICENSING AGREEMENTS, WHERE APPLICABLE, AND THE PROVISIONS OF OUR TOU ENTITLED, “DISCLAIMER OF WARRANTIES,” “LIMITATION OF LIABILITY,” “INDEMNIFICATION,” “GOVERNING LAW, DISPUTE RESOLUTION, ARBITRATION, VENUE, SEVERABILITY OF PROVISIONS,” “NO WAIVER,” AND “ASSIGNMENT.”
You agree to be individually, personally, and financially responsible for all charges or other liabilities Your child incurs via Your child’s use of Our Site or Services. This includes but is not limited to where Your child provides Your credit card information in association with registering an account with Us, or where Your child causes harm to Us or a third-party.
We may collect information about Your child in accord with Our Privacy Policy. For purposes of the Child Online Privacy Protection Act, 15 U.S.C. § 6501-6505, as amended from time-to-time, and for similar privacy statutes. You have “opted-in” to Our data collection practices as outlined in Our Privacy Policy.
You may at any time review Your child’s personal information, direct Us to delete it, and refuse Us to allow any further collection or use of Your child’s information.
You have the option to agree to Our collection and use of Your child’s information, but not allow disclosure of that information to third-parties, although such disallowance may significantly affect Your child’s ability to participate or use the Site or Services.
You may at any time withdraw Your Consent, although any such withdrawal will not affect any prior agreements already entered into on Your child’s behalf in regard to Services already provided or royalties ItyDity or third-parties have earned pursuant to Our Terms of Use.
Any withdrawal of this Consent may cause partial or whole, temporary or permanent interruption, in Our sole and exclusive discretion, to Your child’s use of Our Site or Services.
In accord with applicable law, We will not require Your child to disclose more information than is reasonably necessary to use the Site or otherwise participate in the Services.
YOU AGREE TO RELEASE ITYDITY, INCLUDING ITS PREDECESSORS, SUCCESSORS, SUBSIDIARIES, ASSIGNS, AND INSURERS, FROM ALL PAST, PRESENT, OR FUTURE CLAIMS, WHETHER NOW KNOWN OR UNKNOWN AND REGARDLESS OF THE LEGAL BASIS FOR THE CLAIMS, IN ANY WAY RELATED TO YOUR CHILD’S USE OF THE SITE OR SERVICES IN ACCORD WITH THE PROVISIONS OF OUR TERMS OF USE.
PURSUANT TO OUR TERMS OF USE, IN NO EVENT SHALL ITYDITY OR ITS “RELATED PARTIES,” AS THAT TERM IS DEFINED IN OUR TERMS OF USE, BE LIABLE TO YOU OR YOUR CHILD IN ANY WAY AND FOR ANY DAMAGES OTHER THAN AS SPECIFICALLY ADDRESSED IN OUR TERMS OF USE.

By signing below, You agree You have fully read, understood, and agree with this Consent. You knowingly and voluntarily enter into this Consent, waive all rights and claims as detailed within it, and agree to be bound by this Consent as well as Our Terms of Use. You have either reviewed this Consent with legal counsel or are affirmatively waiving the right to do so. Any dispute regarding this Consent shall be governed under the provision of Our Terms of Use entitled “Governing Law, Dispute Resolution, Arbitration, Venue, Severability of Provisions.”
